When Caleb first offered his services, he worked in the office right next to mine—he now works just across the hall. He acted like he was giving me a special deal, eager to help as my wife and I were launching our first business.

You should know something about his contract. It stated that Caleb would own all “marketing materials.” Reasonably, that would mean things like ads, videos, and photos. However, Caleb claims that includes ownership of our Google Business listing. The contract never mentions that “marketing materials” would include the business listing, and it’s well outside industry norms to interpret it that way. Caleb only revealed this interpretation after we notified him we planned to end our services with him.

After nearly two years working together, we informed Caleb—cordially—that we were moving in a different direction. We thanked him for his work. The contract included a 60-day transition period after written notice. But within 24 hours, he marked our business as “permanently closed” on Google and demanded $10,000 for access to the listing. I avoid confrontation whenever possible, especially with someone I see daily. So, my wife and I built a new listing, requested reviews from past and current clients, and within a week had recovered about 70% of our original review count. I decided to move on.

Months later, while visiting family in Peru, we noticed something shocking. Caleb had republished our old listing under the name of one of our competitors. The listing used only one photo—an old one of my wife and our team wearing our branded company shirts—and included all our original customer reviews. He gave no warning. There was no attempt to distinguish the page from our business, which was clearly misleading and deceptive. Clients looking for us would easily believe they were contacting our company.

When I messaged Caleb about it, he claimed the photo was just an old “customer” image and said he couldn’t remove it. Even if that were true, he made no effort to notify us or differentiate the listing from ours. Even without the photo, republishing that page with our reviews under another business name is both unethical and illegal.

I’ve since spoken with four marketers, all of whom were stunned—each said they’d never seen such blatant misconduct in their field. I’ve also consulted with four attorneys, all of whom immediately recognized Caleb’s actions as fraud and a clear violation of multiple statutes. When I tried to inform clients of the situation, Caleb threatened me with a defamation lawsuit. We’ve sent him a cease and desist letter, yet the fraudulent listing remains active.

Here’s my warning: Caleb had more reason to treat me fairly than almost anyone—our offices are across the hall, and I’ve always been courteous. Despite that, he chose to act in a way that violated legal and ethical standards. If he’s willing to do this to a neighbor and former client he sees daily, I can only imagine what he might do to someone else.
